Anti-Spam & Email Sending Policy

Rules governing the use of business email mailboxes included in every Alta Ignite subscription, covering consent, authentication, sending limits and abuse enforcement.

1. Purpose and scope

  • 1.1 This Anti-Spam & Email Sending Policy applies to all business email mailboxes, transactional email, and marketing email sent using infrastructure provided by Alta Ignite B.V. as part of a subscription plan.
  • 1.2 By using the business email included in your subscription, you agree to comply with this policy in addition to our Terms and Conditions. Breach of this policy is a material breach of your subscription agreement.

2. Definition of unsolicited email

  • 2.1 "Unsolicited email" or "spam" means any commercial or bulk electronic message sent to a recipient who has not given prior affirmative consent to receive it, or who has withdrawn such consent, and which is not a transactional message necessary to complete a transaction the recipient has initiated.
  • 2.2 Harvested, purchased, rented or scraped address lists are treated as unsolicited recipients regardless of how the list was obtained.

3. Consent and proof of consent

  • 3.1 Before sending marketing email, you must obtain consent that is freely given, specific, informed and unambiguous, consistent with GDPR Article 4(11) and the consent standard referenced in ePrivacy Article 13 for electronic marketing communications.
  • 3.2 You must retain evidence of consent, including the date, method (for example a signed-up web form), and the specific wording presented to the recipient at the point of opt-in, for as long as you continue to send that recipient marketing email and for at least two years thereafter.
  • 3.3 Alta Ignite may request proof of consent at any time in response to a complaint, and failure to produce adequate evidence within five business days will be treated as if consent was never obtained.
  • 3.4 Business-to-business marketing to an existing customer for similar products or services may rely on the soft opt-in exception recognised under ePrivacy implementing laws, provided the recipient was given a clear and simple means to refuse such use at the time of collection and in every subsequent message.

4. Required headers, unsubscribe and identification

  • 4.1 Every commercial email sent from mailboxes hosted by Alta Ignite must include accurate "From", "Reply-To" and routing header information that does not mislead the recipient as to the origin of the message, as required by the US CAN-SPAM Act (15 U.S.C. §7704).
  • 4.2 Subject lines must not be deceptive as to the content of the message.
  • 4.3 Every marketing message must identify itself clearly as an advertisement where required by applicable law and must include the sender's valid physical postal address.
  • 4.4 Every marketing message must include a clear and conspicuous mechanism to opt out of future messages, honoured, at the latest, within ten business days of the request, in accordance with CAN-SPAM, and immediately wherever technically feasible to meet ePrivacy Article 13 expectations.

5. Sending limits per plan and per mailbox

  • 5.1 Each subscription plan includes business email suitable for ordinary transactional and low-volume relationship correspondence, not bulk marketing broadcast infrastructure. Sending limits are set out in your plan's fair-use documentation and are generally capped at 500 outbound recipients per mailbox per rolling 24-hour period.
  • 5.2 Clients intending to run marketing newsletters at volume should use a dedicated email service provider integrated with, but separate from, their Alta Ignite mailbox; we can advise on and configure such integrations as part of a Request.
  • 5.3 We reserve the right to throttle or temporarily suspend outbound sending on any mailbox that exceeds fair-use limits or triggers automated abuse detection, pending review.

6. List hygiene and bounce/complaint thresholds

  • 6.1 You must remove hard-bounced addresses from your sending list promptly and must not repeatedly send to addresses that have previously bounced.
  • 6.2 A hard bounce rate exceeding 5% or a spam complaint rate exceeding 0.1% of messages sent in any rolling 7-day period will trigger an automatic review of the mailbox and may result in throttling.
  • 6.3 Repeated breach of the thresholds in Clause 6.2 following a warning notice may result in suspension of outbound sending for the affected mailbox until list hygiene issues are demonstrably resolved.

7. SPF, DKIM and DMARC requirements

  • 7.1 All domains sending email through Alta Ignite infrastructure must have valid Sender Policy Framework (SPF) and DomainKeys Identified Mail (DKIM) records correctly authorising our sending servers.
  • 7.2 We configure a DMARC (Domain-based Message Authentication, Reporting and Conformance) policy for each hosted domain as part of onboarding, and clients must not alter DNS records in a way that breaks SPF, DKIM or DMARC alignment without coordinating with us first.
  • 7.3 Domains that fail to maintain proper authentication may have outbound sending suspended to protect the deliverability reputation of shared sending infrastructure used by other clients.

8. Prohibited content

  • 8.1 You may not use Alta Ignite email infrastructure to send messages that are fraudulent, phishing or deceptive; that contain malware or malicious links; that promote illegal products or services; or that violate the intellectual property, privacy or publicity rights of any person.
  • 8.2 You may not disguise or obscure the subject matter or commercial nature of a message, use misleading sender names, or forge header information.

9. Ban on purchased or third-party lists

  • 9.1 Sending to purchased, rented, scraped, co-registered or otherwise third-party-sourced address lists is strictly prohibited using Alta Ignite email infrastructure, regardless of any claim that the list vendor obtained consent.
  • 9.2 Violation of this clause is treated as a serious breach and may result in immediate suspension of the mailbox without prior warning.

10. Reporting abuse

  • 10.1 Recipients of unwanted email believed to originate from Alta Ignite infrastructure, or third parties observing abuse of our systems, may report it to abuse@altaignite.com, ideally including full message headers.
  • 10.2 We investigate abuse reports within two business days and will take proportionate action, which may include warning, throttling, suspension or termination of the offending mailbox.

11. Investigation process

  • 11.1 Upon receiving a credible complaint or triggering an automated threshold, we may temporarily pause outbound sending on the affected mailbox while we investigate, notifying the client of the reason for the pause.
  • 11.2 We will request the client's explanation and, where relevant, proof of consent under Clause 3, before making a final determination.

12. Suspension and appeal

  • 12.1 Where a violation of this policy is confirmed, we may suspend outbound sending for the affected mailbox or domain, suspend the client's broader subscription where the violation is severe or repeated, or terminate the subscription in accordance with our Terms and Conditions.
  • 12.2 A client subject to suspension may appeal in writing to legal@altaignite.com within 14 days, providing evidence addressing the basis for suspension; we will respond to appeals within ten business days.
  • 12.3 Reinstatement of a suspended mailbox is conditional on the client demonstrating corrected list hygiene practices, valid consent records, and, where applicable, remediation of authentication configuration.

13. Relationship to other policies

  • 13.1 This policy operates alongside our Terms and Conditions and GDPR Compliance & Data Subject Rights page; nothing in this policy limits a recipient's statutory rights under CAN-SPAM, ePrivacy implementing laws, or the GDPR.
